End-User License Agreement (EULA) — Palynx iOS App

1. Parties & Acceptance

This EULA is between Palynx Inc. ("we," "us") and you. Apple is not a party to this EULA. By downloading or using the app, you agree to these terms.

2. License

We grant you a non-transferable, non-exclusive license to use the app on Apple-branded devices you own or control, as permitted by Apple's Usage Rules. All rights not expressly granted are reserved.

3. Account & Eligibility; Compliance

You must be legally able to enter into this agreement and comply with all applicable laws, including export controls and sanctions.

4. Purchases & Billing (No Subscriptions)

No auto-renewal. We do not offer subscription products. Features are available on a pay-as-you-go basis via in-app purchases (e.g., Profile Enhancer, Event Spotlight, Last-Minute Hangout, Super Connect).
Payment. Your Apple ID is charged at the time of purchase confirmation.
Price changes. Future price changes apply to future purchases only.
Refunds. Purchases are with Apple; refunds follow Apple's policies (e.g., reportaproblem.apple.com).
Restore purchases. For non-consumable items, you can restore prior purchases on a new device using the same Apple ID via "Restore Purchases."

5. Privacy

Your use of the app is also governed by our Privacy Policy:https://palynx.com/privacy-policy.

6. Maintenance & Support

We (not Apple) are responsible for app maintenance and support. Apple has no obligation to provide maintenance or support. Contact:support@palynx.com.

7. Product Claims

We (not Apple) are responsible for addressing any claims relating to the app or your use of it, including consumer protection, legal compliance, or privacy claims.

8. Intellectual Property

We (not Apple) are responsible for handling any third-party claims that the app infringes intellectual property rights.

9. Restrictions

You may not copy, modify, reverse engineer, or create derivative works from the app except where permitted by law or by license terms for included open-source components.

10. Third-Party Services

Certain features may rely on third-party services governed by their terms. We are not responsible for those services.

11. Disclaimer

To the maximum extent permitted by law, the app is provided "as is" and "as available," without warranties of any kind. Apple disclaims all warranties with respect to the app.

12. Limitation of Liability

To the extent permitted by law, we won't be liable for indirect, incidental, special, or consequential damages. In any case, our total liability is limited to the amount you paid to us for the relevant in-app purchase.

13. Termination

This EULA remains in effect until terminated by you or us. Your rights end automatically if you breach it. You may stop using the app and remove it from your devices to terminate.

14. Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

15. Export & Sanctions

You represent that you are not located in an embargoed country and are not on any U.S. government restricted party list, and you will comply with applicable export laws.

16. Governing Law & Venue

This EULA is governed by [choose: New York, USA / your preferred jurisdiction] law, without regard to conflict-of-law rules. Courts in [choose venue] will have jurisdiction where permitted by law.

17. Changes

We may update this EULA; we'll post the new version in-app and/or athttps://palynx.com/terms. Continued use after changes means you accept them.
